The ex-lawyer for the former president has resigned as New Jersey's top federal prosecutor. This comes after a judicial decision that questioned her right to occupy the role.
Attorney General's Statement
The nation's top law enforcement official, Pam Bondi, confirmed Habba's resignation on the start of the week. In a statement that the court's "flawed" ruling made it unworkable for the official to lead the department effectively.
"But do not mistake following the order as giving up," she declared. "This battle will now extend throughout America."
Judicial Challenge
Her resignation was triggered by a federal appellate panel determined that she had been unlawfully serving as the top prosecutor. This decision is expected to impact many criminal cases in New Jersey.
The judicial panel ruled that a interim role that bypassed Senate approval breached the statute on vacant positions.
Future Role and Reaction
Bondi said that Habba will continue working within the Department of Justice as a senior adviser. Habba plans to challenge the decision of the disqualification, in the hope of achieving a different outcome.
In a statement, she wrote that judges "cannot be permitted to override the executive's selection of lawyers tasked with executing the executive branch's core responsibility of enforcing the law."

She commended Habba's record and noted that under her leadership, the city of Newark saw a significant drop in criminal activity. Additionally that the southern city of Camden had its first summer in half a century free from homicides.
Legal Career
Habba, 41, originally became part of the former president's legal defense in recent years. She went on to defended the former president in his New York criminal case in 2024, when he was conviction on multiple felony counts of falsifying business records.
Earlier, assuming the role of US Attorney, the former president had announced he was naming her as his senior adviser during his second administration, labeling Habba as a steadfast ally and a dedicated fighter for justice.
